Why do I need Medical Malpractice?  Healthcare providers are ethically and legally responsible for providing quality medical care to their patients.  Because of increasing expectations for the healthcare delivery system, podiatrists in the United States find themselves practicing in a highly litigious environment.  Even if the malpractice claim is meritless podiatrists could face costly legal expenses typically in the tens of thousands just to defend the case.  Medical Malpractice or Professional liability coverage pays the cost of defense of a claim and if the podiatrist is found negligent, the policy will pay the money awarded to the patient (indemnity payment).

How long has Podiatry PLUS been insuring podiatrists?  The program then called Podiatrist Plus Plan was launched in 1998.  ACE American Insurance Company through its ACE Medical Risk division as been the underwriting carrier since 2001.

What is claims-made coverage?  Type of coverage that requires that a medical incident occur after the retroactive date and that the claim be made against the insured while the policy is in effect.  Under a claims-made coverage form, the policy terms and limits currently in effect will respond to the claim demand provided there has been continuous coverage back to the retroactive date. Under an “occurrence” coverage form, the policy that was in effect at the time of the medical incident responds to the claims demand.

What is prior acts coverage?  Also known as “nose” coverage, this feature affords coverage back to the retroactive date on the policy.  Coverage applies  on a “first year” or retro date inception basis if prior acts coverage is not provided.

What is Extended Reporting Period (ERP) coverage?  Also called “tail” coverage, ERP extends the claims-reporting provisions for a specific time period beyond the policy expiration date, for any claims arising from medical incidents that occurred after the retroactive date and prior to the expiration of the policy.

What is an “incident” reporting provision of a policy?  This provision allows the policyholder to report probable claims events, such as a request for patient records, to the insurance carrier in advance of receiving an actual written claim demand.  The policy coverage is triggered at the time of the incident reporting.
